New Square teacher labeled sex offender after guilty plea

NEW SQUARE — A teacher has been classified as a low-level sex offender based upon his recent conviction for forcibly touching a young boy.
         
        Herschel Taubenfeld pleaded guilty earlier this month to the misdemeanor charge as part of a plea agreement with prosecutors in New Square Village Court. The agreement spared the child from having to testify.
      
        Taubenfeld’s was the first sexual abuse case prosecuted in the New Square community, said Rabbi Noson Leiter, the founder of Help Rescue Our Children, an Orthodox Jewish children’s advocacy group. Leiter also heads Torah Jews for Decency in Monsey.

         Leiter and other advocates have claimed some community leaders keep the lid on sexual abuse and other crimes, pressuring families and survivors to steer clear of reporting abuse to police and testifying in court. Leiter said that despite the lack of jail time in the Taubenfeld case, the case sends a message that a victim can force a plea.

         Leiter said Taubenfeld’s admission to molestation charges confirms that current New Square leadership clearly failed to stop him. “Thus, New Square families need the leadership and assistance of those outside of New Square to protect their innocent children,” he said, “and to raise them in the spirit of holiness, on which the village of New-Square was originally founded.

        “We still have no idea of how many other victims may be suffering in silence,” Leiter said.

    Your YouTube discussion of sexually abused child by Rabbi Taubenfeld is of interest to me. As an orthodox Jew who has been studying the Tanakh and Talmud (Rabbinical Judaism) for a number of years, have had some questions concerning the sexual abuse of children which has been found by my study group.



    As your organization Help Rescue our Children, was wondering if you were aware of the following Talmudic psukim? Our local rabbis have been unwilling to give some context to the following text. I would appreciate your opinion of whether Hashem could have given any hint of these passages in His Oral Law to Moshe?



    Sanhedrin 55b:4



    אמר רב יוסף תא שמע בת שלש שנים ויום אחד מתקדשת בביאה ואם בא עליה יבם קנאה וחייבין עליה משום אשת איש



    Rav Yosef says: Come and hear a resolution from a mishna (Niddah 44b:9-11): A girl who is three years and one day old whose father arranged her betrothal is betrothed with intercourse, as the legal status of intercourse with her is that of full-fledged intercourse. And in a case where the childless husband of a girl who is three years and one day old dies, if his brother, the yavam, engages in intercourse with her, he acquires her as his wife; and if she is married, a man other than her husband is liable for engaging in intercourse with her due to the prohibition of intercourse with a married woman.



    Ketubot 11b:5-7

    Rav Oshaya raised an objection to the opinion of Rav from the mishna: With regard to an adult man who engaged in intercourse with a minor girl less than three years old, or a minor boy less than nine years old who engaged in intercourse with an adult woman, or a woman who had her hymen ruptured by wood or any other foreign object, the marriage contract for each of these women is two hundred dinars. This is the statement of Rabbi Meir. And the Rabbis say: The marriage contract of a woman whose hymen was ruptured by wood is one hundred dinars. Contrary to Rav’s opinion, the Rabbis distinguish between the halakha in the case of the intercourse of a minor boy and the halakha in the case of a woman whose hymen was ruptured by wood.

    Rava said that this is what the mishna is saying: An adult man who engaged in intercourse with a minor girl less than three years old has done nothing, as intercourse with a girl less than three years old is tantamount to poking a finger into the eye. In the case of an eye, after a tear falls from it another tear forms to replace it. Similarly, the ruptured hymen of the girl younger than three is restored. And a young boy who engaged in intercourse with an adult woman renders her as one whose hymen was ruptured by wood. And with regard to the case of a woman whose hymen was ruptured by wood itself, there is a dispute between Rabbi Meir and the Rabbis. Rabbi Meir maintains that her marriage contract is two hundred dinars, and the Rabbis maintain that it is one hundred dinars.
